By contracting, accessing, activating, renewing, or continuing to use any GeHost service, you state that you have read, understood, and fully accepted the terms and conditions below.

1. Acceptance of the Terms

By accessing, contracting, activating, renewing or continuing to use any GeHost service, the client declares that they have read, understood and fully accepted this document, as well as any supplementary policies published on the website, in the client panel, in commercial proposals or in official communications. Continued use of the service after contracting, activation, renewal, an update to these terms or the opening of a support ticket constitutes unequivocal electronic acceptance, and the client may not claim lack of awareness of these conditions thereafter.

2. Description of the Services

4. Acceptable Use Policy

Clause updated on October 2, 2026, effective as of this date.

4.1. General rule. It is prohibited to use GeHost services for illegal or abusive activities, including, without limitation: spam, phishing, malware, botnets, unauthorized scans, attacks, exploitation of vulnerabilities, hosting of illicit content, child pornography, copyright infringement, fraud, abusive mining, unauthorized resale of resources, excessive consumption that harms third parties, evasion of blocks, improper mass email sending, use of purchased lists, storage or distribution of malicious content and any practice that infringes accepted technical standards of the internet.

4.2. Betting and games of chance. It is prohibited to host, promote, or direct traffic to fixed-odds betting, online casinos, “tigrinho”-style games, jogo do bicho, or any other game of chance without the federal authorization required by Law No. 14.790/2023 and the regulations of the Secretariat of Prizes and Bets of the Ministry of Finance, which are also subject to Decree-Law No. 3.688/1941 (Criminal Contraventions Law). News stories, analyses, and informational content on the topic are not prohibited by this clause.

4.3. Phishing, scams, and fraud. It is prohibited to publish pages that imitate banks, government agencies, companies, or brands in order to obtain passwords, card details, documents, or other personal data, as well as misleading offers of financial gain, fake charges, and any other means of committing fraud against third parties.

4.4. Malware and abusive sending. It is prohibited to distribute viruses, malicious programs, fake software updates, or scripts that trick visitors into running commands, and to send unsolicited bulk messages from GeHost's infrastructure.

4.5. Automated verification. To protect customers, visitors, and the reputation of the network, GeHost automatically checks the publicly accessible content of hosted sites and technical security signals, such as server antivirus alerts, email sending volume, and blocklists. On VPS and Bare Metal servers, this verification is limited to what is publicly accessible and to network signals; GeHost does not access the internal content of the customer's server for this purpose. This verification does not involve reading emails or the customer's databases.

4.6. Preventive suspension and right of defense. If there is consistent evidence of a violation of this policy, GeHost may preventively suspend the service, in whole or in part, to stop harm to third parties or the network, without prejudice to the other measures provided for in these terms. The customer will be notified through the registered contact channels, with an indication of the reason, and may provide clarification and request reactivation through support. Once the irregular content is removed, or once it is shown that there was no violation, the service will be reactivated. Preventive suspension does not, by itself, imply deletion of the customer's data.

4.7. Authorities and records. GeHost complies with court orders and requests from competent authorities and may preserve records and evidence related to the violation, in accordance with Law No. 12.965/2014 (Marco Civil da Internet), Law No. 13.709/2018 (LGPD), and applicable legislation.

5. Availability, Infrastructure and SLA

GeHost makes commercially reasonable efforts to keep its services available and functional, subject to preventive and corrective maintenance, technical windows, security updates, third-party failures, and events beyond its control. GeHost's role focuses on infrastructure, connectivity, the operability of the contracted environment, and delivery of the service in initial working condition. GeHost assumes no responsibility for the internal administration of customer systems, configuration errors, application failures, incompatibilities, performance loss caused by software installed by the customer, improper operation, third-party code, compromised credentials, or inadequate use of resources.

6. Backup and Data Recovery

Unless a specific backup service is expressly and formally contracted, GeHost is not responsible for performing backups, retention, versioning, validation, off-site storage, or restoration of customer data. The customer is solely responsible for keeping backup copies up to date, tested, and stored in an independent location. GeHost does not guarantee data recovery in the event of deletion, corruption, logical failure, human error, ransomware, intrusion, misuse, nonpayment, suspension, software crash, application failure, or any event that affects the customer's data.

7. Limitation of Liability

GeHost will not be liable for data loss, operating system failures, application failures, bugs, failed updates, database corruption, unavailability caused by customer software, intrusions resulting from insecure credentials, improper configurations, third-party scripts, routines without backups, indirect damages, lost profits, loss of opportunity, reputational harm, or consequential damages. Where legally applicable, GeHost's total liability will be limited to the amount actually paid for the affected service in the 12 months prior to the event.

8. VPS, Bare Metal, Administrative Access and Fair Use

GeHost's VPS and dedicated server (Bare Metal) services are provided with the resources of the contracted plan, administrative access where applicable, and operation subject to the fair use policy. The customer is responsible for everything they install, run, store, transmit, or automate on the server. GeHost may intervene in, limit, suspend, or terminate the service if it identifies a risk to the infrastructure, abuse of CPU, RAM, I/O, or network, improper email sending, use contrary to legislation, a security incident, improper exploitation of resources, or operation that compromises the stability of the environment or of third parties. Optional resources, internal administration, licenses, and backup routines are only part of the service when expressly provided for in the plan or the proposal.

8.1. MailGe and Email Services

MailGe is GeHost's official interface for accessing eligible professional mailboxes. The number of accounts, capacity, integrations, and available features depend on the contracted plan and the account configuration. The customer is responsible for protecting their credentials, for the recipients chosen, and for the content sent, stored, or shared. Message delivery and receipt also depend on filters, reputation, rules, and the availability of external providers, and universal delivery is not guaranteed. GeHost's published Email Policies also apply.

8.2. Cortex and Artificial Intelligence Features

Cortex is an artificial intelligence product from GeHost made available according to the plan, the access surface, and the enabled features. The customer is responsible for the instructions, files, and content submitted, for the use of the results, and for human validation before using them in decisions, publications, code, customer service, or other activities. Responses generated by artificial intelligence may contain inaccuracies and do not replace professional assessment when it is necessary. Permissions, integrations, history continuity, and usage limits depend on the configuration and conditions of the contracted plan.

8.3. Datacenter Infrastructure and Third-Party Provider (VPS, Bare Metal and GPU)

Clause revised on October 24, 2026.

Origin of the infrastructure. The VPS, Bare Metal and Dedicated GPU services marketed by GeHost run on physical datacenter infrastructure supplied by an independent company with no corporate affiliation with GeHost. GeHost contracts for this capacity in its own name, under its registered company name and Brazilian corporate taxpayer registration number (CNPJ), and provides it to the client as its own service. The provider's identity and the terms of its contract with GeHost are GeHost's confidential commercial information and are not disclosed.

Contractual relationship. The client's contract is exclusively with GeHost. There is no direct contractual relationship between the client and the datacenter provider, nor does the client have any right to pursue claims directly against that provider. All technical and commercial communication with the datacenter is handled by GeHost.

Scope of GeHost's responsibilities. GeHost is responsible for: (i) provisioning, initial configuration and delivery of a functioning environment; (ii) maintaining the layer under its control, including the management panel, system images, virtual network, snapshots and reinstallation where applicable to the plan; (iii) technical support in Portuguese throughout the client's service experience; (iv) opening, tracking and escalating tickets with the datacenter provider, at no additional cost and without transferring this task to the client; and (v) communicating incidents, maintenance windows and timeframes reported by the provider.

Outside GeHost's scope. The following are not part of the service provided by GeHost, as they depend on a third party: (i) physical infrastructure, including power, cooling, hardware, transit links and backbone routing; (ii) unavailability, degradation, packet loss, latency or failures originating in the physical layer or the provider's network; (iii) the provider's operational decisions, such as scheduled maintenance, migrations, network changes and policy changes; and (iv) force majeure events, fortuitous events, volumetric attacks and orders from competent authorities.

Response to third-party incidents. If an event occurs in the layer described above, GeHost will act as the client's representative before the provider, using commercially reasonable efforts to restore service and seeking, where applicable, the credits or compensation provided for in its contract with the datacenter, which will be passed on proportionally to the affected client.

Price composition. The amounts charged remunerate the service provided by GeHost (provisioning, management layer, support in Portuguese and intermediation with the provider) and do not constitute a guarantee of uninterrupted availability of the physical infrastructure operated by a third party.

Limits of this clause. Nothing in this section excludes liabilities mandatorily imposed on the supplier by applicable law, in particular those arising from the Brazilian Consumer Protection Code in consumer relationships, whose provisions prevail over this clause to the extent of any conflict. In business-to-business contracts where the service is an input to the contracting party's economic activity and there is no consumer relationship, the limitations in this section apply in full, pursuant to the freedom of contract provided for in the Brazilian Civil Code.

8.4. Dedicated Servers (Bare Metal) and Dedicated GPU

Version 1.0, effective October 24, 2026. This section supplements the other clauses of these Terms for Bare Metal dedicated servers and servers with a dedicated GPU. In the event of a conflict, this section prevails for those services.

8.4.1. Unmanaged service. The server is delivered with the chosen operating system, a client account with administrative privileges (sudo) and a functioning network. From delivery onwards, the client administers the server: installation, configuration and updates of the operating system, drivers, libraries, applications, firewall, security, monitoring and backups. GeHost support covers delivery, panel access, the network, the contracted hardware and the actions available in the client area (power on, shut down, restart, reinstall, recovery mode and snapshots, where available). Internal software configuration is performed only under a separate specific service agreement.

8.4.2. Delivery timeframe and availability. Delivery takes place within 48 (forty-eight) hours after payment confirmation and is subject to equipment availability in the chosen region. The timeframe may be extended for registration or anti-fraud checks, in which case the client is notified. If equipment is unavailable, GeHost notifies the client and offers, at the client's choice: (i) a full refund of the amount paid for the undelivered service, to the original payment method, within 10 (ten) business days after that choice; (ii) credit for the same amount to the GeHost account; or (iii) waiting for the new date provided by GeHost.

8.4.3. Access and credentials. Access details are sent by email and are available in the client area. Upon receiving the server, the client must change the password, favor SSH keys and restrict administrative access. A password changed within the operating system itself is not reflected in the panel. Password resets, reinstallation and recovery mode initiated through the panel generate a new password, displayed once only.

8.4.4. Availability and SLA. GeHost uses commercially reasonable efforts to keep power, network and hardware available, subject to clauses 5 and 8.3. Unless a formal proposal specifies a numerical SLA, there is no percentage availability guarantee. Continuous unavailability exceeding 24 (twenty-four) hours caused by physical infrastructure, hardware or the network, rather than by the client's actions or software, entitles the client to credit proportional to the downtime, upon a request to support within 30 (thirty) days. The following are not covered: failures of the client's operating system, drivers, applications or configuration; attacks and security incidents on the server; notified scheduled maintenance; hardware replacement time subject to parts availability; suspensions provided for in these Terms; and force majeure events.

8.4.5. Backups and data. Backups are the client's sole responsibility and must be kept outside the server itself. Snapshots, where available, are a convenience feature and do not replace backups: their number is limited, they may expire automatically and they are lost in the event of hardware failure or service termination. Reinstalling the system erases all disk contents. GeHost does not recover deleted, corrupted or lost data. When the service ends for any reason, the disks are permanently erased.

8.4.6. Specific acceptable use. In addition to clause 4, it is prohibited to use the server for: (i) cryptocurrency mining or equivalent activity, including storage, GPU or CPU mining; (ii) sending spam, unsolicited bulk messages or hosting mailing lists without consent; (iii) attacks of any kind, denial of service, unauthorized scans, cracking third-party passwords, botnets, command-and-control servers and open proxies or VPNs used for abuse; (iv) illegal content, including child sexual abuse material, piracy and fraud, as well as using the GPU to generate or distribute such content or intimate images without consent; and (v) use of the network or GPU that harms other clients or the infrastructure. Traffic is subject to the fair use policy: sustained consumption far above the plan's usage profile may result in bandwidth being limited after notice, or in a proposal for a suitable plan.

8.4.7. Suspension for abuse. Upon receipt of an abuse notice, the client has 24 (twenty-four) hours to respond and remedy the issue. In the event of ongoing harm or serious indications (attack, mining, illegal content, server compromise), GeHost may shut down or isolate the server immediately under clause 4.6 and reactivate it once the issue is resolved. Repeat offenses or a serious violation may lead to termination of the service without a refund for the current period.

8.4.8. Price and billing. The reference price for these services is in US dollars (USD), with monthly billing in advance and automatic renewal. For invoices issued in Brazilian reais or Japanese yen, the amount is converted using the reference dollar exchange rate on the issue date, which may include a foreign exchange margin, and may therefore vary from month to month. The taxes and payment method rules in clause 12 apply. Any activation fee is disclosed before purchase and is non-refundable after server delivery.

8.4.9. Late payment. Suspension for non-payment follows clause 13. As the equipment is reserved exclusively for the client, if payment remains overdue for 15 (fifteen) days after the due date, the service may be terminated and the equipment released, with permanent deletion of the data.

8.4.10. Cancellation and refunds. The client may request cancellation at any time through the client area, effective at the end of the paid billing cycle or, if preferred, immediately. Before server delivery, the amount paid is refunded in full. After delivery, there is no refund for the current period under clause 17, except for delivery failure or unavailability attributable to GeHost as provided in item 8.4.4. Before cancelling, the client must copy their data.

8.4.11. Limitation of liability. Clause 7 applies in full. GeHost is also not liable for loss of processing, training results or computations interrupted by failure, maintenance, reinstallation or suspension.

8.4.12. Provider identification and confidentiality. Hostnames, reverse DNS, the panel, emails and support are provided under the GeHost brand. The client must not contact the datacenter provider; all requests go through GeHost under clause 8.3.

8.4.13. GeHost maintains its own administrative access on each server (a unique key per server), used only for support, security and maintenance at the Client’s request; the Client receives an account with administrative privileges (sudo) and is responsible for its use.

8.4.14. History of this section. Version 1.0 (October 24, 2026): creation of the Bare Metal and Dedicated GPU section and revision of clause 8.3.

8.5. Shared GPU (private AI on a shared GPU)

This section supplements the Terms of Service for Shared GPU. In case of conflict, this section prevails for this service.

8.5.1. Scope. GeHost provides private AI through an OpenAI-compatible endpoint, with a model installed by GeHost. The client has no access to the machine, operating system or GPU administration.

8.5.2. Sharing and performance. Each GPU serves at most 2 (two) tenants. Performance may vary with the other tenant’s usage. GPU exclusivity is not guaranteed; Dedicated GPU is the appropriate product for exclusive use.

8.5.3. Access and security. Access requires a valid token and an IP or network registered in the client area. No registered IP means no requests are accepted. The client is responsible for safeguarding the token, restricting IPs and revoking or replacing the token if exposure is suspected.

8.5.4. Privacy. Request and response content is never stored, including in logs. Only usage counts and technical metadata required for service operation, security and billing are kept.

8.5.5. Price and occupancy. One paying tenant pays the full price. With two paying tenants, each service receives the shared GPU discount on its service invoice line, excluding taxes, fees and other lines. GeHost internal usage does not count as a tenant. Occupancy changes apply from the next invoice and are announced by email before it is issued. Billing is monthly, in the account currency, at the amounts stated when contracting and in applicable notices.

8.5.6. Delivery. Private AI is ready within 48 (forty-eight) hours after payment confirmation. Delivery may involve replacing the GPU with an equivalent one while preserving the contracted resources. The endpoint, model and token and IP management are available in the client area under the relevant service.

8.5.7. Right of withdrawal. Individuals may withdraw within 7 (seven) days from contracting, with a full refund, under article 49 of the Brazilian Consumer Protection Code (CDC). Requests are made through the client area or support.

8.5.8. Subsequent cancellation. After the withdrawal period, the client may cancel without a refund for the current month. The service remains available until the end of the paid period, subject to suspension or termination for violations of these Terms and statutory rights.

8.5.9. Acceptable use and limits. The acceptable use rules of these Terms apply. The client must respect the fair concurrency and per-tenant context limits stated in the plan and panel. Requests above those limits may be queued or rejected, without increasing contracted resources.

8.5.10. GPU replacement. If the GPU in use becomes unavailable, GeHost migrates the service to another equivalent GPU at no additional cost. If no equivalent GPU is available, the customer may cancel and receive a prorated refund for the paid and unused period.

9. Termination, Suspension and Account Closure

Either party may terminate the contractual relationship in accordance with the applicable commercial conditions. GeHost may suspend or terminate services immediately in the event of a violation of these terms, abuse, non-payment, legal order, malicious activity, security compromise, or any situation that puts at risk its infrastructure, third parties, or compliance with the law.

10. Modifications to the Terms

GeHost may update these terms, policies, operational workflows, technical limits, and commercial conditions at any time, by publishing them on the website, the client panel, a proposal, the registered email address, or another official channel. Continued use of the service after the update constitutes agreement with the new version.

11. Acknowledgment, Record and Evidence of Acceptance

For evidentiary and transparency purposes, the following may be considered as evidence of knowledge and acceptance: contracting via the website, acceptance in a proposal, payment of the invoice, opening of a support ticket, renewal, activation of the service, use of the panel, sending of credentials, email confirmations, access logs, system records, tickets, and official communications. By using the service, the client agrees that such records may be used to demonstrate the contracting and the knowledge of the current terms.

12. Payments, Payment Methods and Tax Invoices

Clause updated on September 30, 2026. This translation is provided for convenience only; the Portuguese version of these Terms prevails.

12.1. Official channels. Payments must be made exclusively through the methods and channels indicated on the invoice or in the client area; transactions through any other means are not permitted. The invoice is marked as paid automatically once the payment is confirmed.

12.2. Price according to payment method. As permitted by Brazilian Law No. 13,455/2017, the price may vary according to the payment method and term chosen by the client. Payment via Pix is made at the invoice amount, with no surcharge. Payment by card, credit or debit, is subject to the card payment surcharge, which covers the costs of processing, fraud prevention and, where applicable, installments. This surcharge is paid by the client who chooses this payment method.

12.3. Transparency before payment. In accordance with the right to clear and adequate information (Articles 6, III, and 31 of the Brazilian Consumer Protection Code), before confirming a card payment the client is shown the invoice amount, the surcharge on a separate line with its percentage, the total amount payable and the purpose of the surcharge. No surcharge is charged without this prior disclosure. Once the payment is confirmed, the surcharge is added to the invoice as a separate item.

12.4. Installments. When available, card payments may be split into up to 2 (two) installments on invoices of up to R$ 500.00 and up to 4 (four) installments on invoices above that amount. Each option carries its own surcharge, shown before payment together with the installment amount and the total.

12.5. Invoices in foreign currency. On invoices issued in another currency, such as Japanese yen, card payments are also subject to the surcharge, calculated and shown in the invoice currency. The installments described in item 12.4 apply to invoices in Brazilian reais.

12.6. Tax invoice (nota fiscal) and taxes. Taxes levied on the service are itemized on the invoice whenever a nota fiscal (Brazilian tax invoice) is issued, as a separate item labeled “Impostos da nota fiscal” (tax invoice taxes) showing the applicable percentage, and form part of the total amount paid by the client. Clients who wish to receive a nota fiscal must indicate this in their account details (“Emitir NFE” option) or request it from our support team, keeping their billing details up to date. The nota fiscal is not generated automatically with the invoice: once issued, it is made available in the client area, among the account files, or sent by our support team.

13. Delays and Non-Payment

In the event of default, the service will be automatically suspended after 7 (seven) days of delay. If the delay persists for 30 (thirty) days, all data linked to the service will be permanently and irreversibly deleted, with no possibility of recovery, in accordance with the current policy.

The Contracted Party shall not be liable for any losses, damages, or harm arising from the deletion of data, it being the responsibility of the Contracting Party to previously make a proper backup copy of the information it considers essential.

14. Development Services and Digital Agency

The Contracted Party offers professional website, system, and digital platform creation, development, and maintenance services, carried out on demand and in a customized manner.
All development is carried out exclusively according to the guidelines and materials provided by the Contracting Party.

The Contracted Party is not responsible for content sent or requested by the Contracting Party, including texts, images, videos, logos, products, prices, or any material published on the final website or system; full responsibility for the content lies exclusively with the Contracting Party.

The Contracted Party reserves the right to refuse or interrupt any request for the creation of content or functionality that involves:
- Illegal activities of any nature;
- Violations of human rights;
- Violation of Brazilian or international government laws;
- Plagiarism, misuse of trademarks or copyrights;
- Unlawful, defamatory, or discriminatory content, or content that contradicts current legislation.

15. Payment Terms for Development Services

Contracting the creation and development services requires payment of:
- 50% (fifty percent) of the total amount at the beginning of the project, so that the service can be started;
- The remaining 50% (fifty percent) upon delivery, according to the agreed deadline — generally between 3, 5, and 10 business days, depending on the complexity of the project.

The amount related to hosting and domain registration is not included in the development fee and must be paid separately, according to the current price table or as negotiated with the Contractor's representative. Such amounts may vary according to the country of origin, the currency used, and other contractual conditions; no payment is made to personal accounts. All charges are issued exclusively in the name of: G e Soluções e Eventos LTDA, via Pix, PayPal, or other official means made available by the Contractor.

- The conditions of clause 12 also apply to these services: card payment is subject to the surcharge for card payment, informed before confirmation, and, if a nota fiscal (official invoice) is issued, the taxes levied on the service are shown on the invoice as a separate item.

The Contractor undertakes to charge fair prices in accordance with the complexity, delivery, and characteristics of the service contracted.

16. Cancellation, Refund and Legal Conditions for Development Services

The 50% amount paid upon contracting is non-refundable, due to operational costs and the immediate start of planning, design, programming, and other internal work stages.
Likewise, amounts paid for domain registration and hosting are non-refundable, as they are third-party services activated immediately after contracting.

Brazilian legislation (Consumer Protection Code – CDC) provides for a 7-day right of withdrawal for purchases made outside the commercial establishment, exclusively for unused products or services. However, the service contracted in this case is personalized, custom-made, and started immediately, which characterizes:
- partial or total consumption of the service, immediate execution, a customized digital product, and the impossibility of “returning” the service.

In these specific cases, the right of withdrawal does not apply, in accordance with the legal understanding widely used for personalized digital services.

By confirming the contracting, the Contracting Party declares that they are aware of and agree that:
- The project starts immediately after the initial payment;
- Technical hours are consumed and operational costs are incurred from the first day;
- Therefore, there is no refund of the amounts already paid.

17. Refund Policy and General Right of Withdrawal

GeHost / G e Soluções e Eventos LTDA provides digital services, including, but not limited to:
website hosting, VPS servers, email accounts and MailGe, Cortex, webchat/omnichannel, licenses, systems, administrative panels, server activations, technical configurations, and other digital products provided by the company.

Because they are digital services activated immediately, which generate operational costs and consume resources at the time of contracting, the right of withdrawal provided for in art. 49 of the CDC does not apply after the service has been activated. Therefore:

- There is no refund for services that have already been activated, configured, or made available.
- Contracting implies awareness that this is a digital service, and that return or retroactive cancellation is not possible.
- The customer is responsible for assessing their needs in advance before purchasing.

Refunds will only be considered when the service has not yet been activated, or in exceptional situations assessed by the administrative team.

18. Domain, Ownership and Transfer

GeHost clarifies that it does not act as an official registrar with Registro.br, ICANN, or any other entities responsible for domain registrations. The company only provides intermediary, guidance, and registration services, performing the registration and management of the domain on behalf of the client or, when requested or necessary to make the service viable, on behalf of its legal representative, Raphael das Neves Ferreira, or under the CNPJ “G e Soluções e Eventos LTDA”.

When a domain is registered in the name of GeHost, its legal representative, or its legal entity, this is done exclusively to facilitate the initial technical process and does not imply an automatic transfer of ownership to the client without a proper formal request.

If the client wishes to change ownership to their own name, CPF, CNPJ, or any other designated responsible party after the registration has been completed by GeHost, a technical service fee will be charged to cover:

1. Time for analysis, verification, and release of the domain;

2. Administrative and operational procedures before the official registrar;

3. Technical work performed by the GeHost team in the migration and transfer process.

The transfer will only be performed after the technical fees have been paid and the identity of the new holder has been confirmed, in accordance with the requirements established by the official registrar (e.g., Registro.br).

GeHost is not responsible for delays or impossibilities of transfer arising from the policies, internal rules, or requirements of the registering authority.

Customer Service with Artificial Intelligence (AI)

GeHost uses Artificial Intelligence (AI) in its support channels (chat, WhatsApp, and tickets), with transparency and without losing human contact. When using these channels, the client may be assisted by an AI, in accordance with the Consumer Protection Code and the General Data Protection Law (LGPD – Law No. 13.709/2018). Human assistance can be requested at any time. Data processing is detailed in the Privacy Policy.
