Version 1.0, effective October 24, 2026. This section supplements the other clauses of these Terms for Bare Metal dedicated servers and servers with a dedicated GPU. In the event of a conflict, this section prevails for those services.
8.4.1. Unmanaged service. The server is delivered with the chosen operating system, a client account with administrative privileges (sudo) and a functioning network. From delivery onwards, the client administers the server: installation, configuration and updates of the operating system, drivers, libraries, applications, firewall, security, monitoring and backups. GeHost support covers delivery, panel access, the network, the contracted hardware and the actions available in the client area (power on, shut down, restart, reinstall, recovery mode and snapshots, where available). Internal software configuration is performed only under a separate specific service agreement.
8.4.2. Delivery timeframe and availability. Delivery takes place within 48 (forty-eight) hours after payment confirmation and is subject to equipment availability in the chosen region. The timeframe may be extended for registration or anti-fraud checks, in which case the client is notified. If equipment is unavailable, GeHost notifies the client and offers, at the client's choice: (i) a full refund of the amount paid for the undelivered service, to the original payment method, within 10 (ten) business days after that choice; (ii) credit for the same amount to the GeHost account; or (iii) waiting for the new date provided by GeHost.
8.4.3. Access and credentials. Access details are sent by email and are available in the client area. Upon receiving the server, the client must change the password, favor SSH keys and restrict administrative access. A password changed within the operating system itself is not reflected in the panel. Password resets, reinstallation and recovery mode initiated through the panel generate a new password, displayed once only.
8.4.4. Availability and SLA. GeHost uses commercially reasonable efforts to keep power, network and hardware available, subject to clauses 5 and 8.3. Unless a formal proposal specifies a numerical SLA, there is no percentage availability guarantee. Continuous unavailability exceeding 24 (twenty-four) hours caused by physical infrastructure, hardware or the network, rather than by the client's actions or software, entitles the client to credit proportional to the downtime, upon a request to support within 30 (thirty) days. The following are not covered: failures of the client's operating system, drivers, applications or configuration; attacks and security incidents on the server; notified scheduled maintenance; hardware replacement time subject to parts availability; suspensions provided for in these Terms; and force majeure events.
8.4.5. Backups and data. Backups are the client's sole responsibility and must be kept outside the server itself. Snapshots, where available, are a convenience feature and do not replace backups: their number is limited, they may expire automatically and they are lost in the event of hardware failure or service termination. Reinstalling the system erases all disk contents. GeHost does not recover deleted, corrupted or lost data. When the service ends for any reason, the disks are permanently erased.
8.4.6. Specific acceptable use. In addition to clause 4, it is prohibited to use the server for: (i) cryptocurrency mining or equivalent activity, including storage, GPU or CPU mining; (ii) sending spam, unsolicited bulk messages or hosting mailing lists without consent; (iii) attacks of any kind, denial of service, unauthorized scans, cracking third-party passwords, botnets, command-and-control servers and open proxies or VPNs used for abuse; (iv) illegal content, including child sexual abuse material, piracy and fraud, as well as using the GPU to generate or distribute such content or intimate images without consent; and (v) use of the network or GPU that harms other clients or the infrastructure. Traffic is subject to the fair use policy: sustained consumption far above the plan's usage profile may result in bandwidth being limited after notice, or in a proposal for a suitable plan.
8.4.7. Suspension for abuse. Upon receipt of an abuse notice, the client has 24 (twenty-four) hours to respond and remedy the issue. In the event of ongoing harm or serious indications (attack, mining, illegal content, server compromise), GeHost may shut down or isolate the server immediately under clause 4.6 and reactivate it once the issue is resolved. Repeat offenses or a serious violation may lead to termination of the service without a refund for the current period.
8.4.8. Price and billing. The reference price for these services is in US dollars (USD), with monthly billing in advance and automatic renewal. For invoices issued in Brazilian reais or Japanese yen, the amount is converted using the reference dollar exchange rate on the issue date, which may include a foreign exchange margin, and may therefore vary from month to month. The taxes and payment method rules in clause 12 apply. Any activation fee is disclosed before purchase and is non-refundable after server delivery.
8.4.9. Late payment. Suspension for non-payment follows clause 13. As the equipment is reserved exclusively for the client, if payment remains overdue for 15 (fifteen) days after the due date, the service may be terminated and the equipment released, with permanent deletion of the data.
8.4.10. Cancellation and refunds. The client may request cancellation at any time through the client area, effective at the end of the paid billing cycle or, if preferred, immediately. Before server delivery, the amount paid is refunded in full. After delivery, there is no refund for the current period under clause 17, except for delivery failure or unavailability attributable to GeHost as provided in item 8.4.4. Before cancelling, the client must copy their data.
8.4.11. Limitation of liability. Clause 7 applies in full. GeHost is also not liable for loss of processing, training results or computations interrupted by failure, maintenance, reinstallation or suspension.
8.4.12. Provider identification and confidentiality. Hostnames, reverse DNS, the panel, emails and support are provided under the GeHost brand. The client must not contact the datacenter provider; all requests go through GeHost under clause 8.3.
8.4.13. GeHost maintains its own administrative access on each server (a unique key per server), used only for support, security and maintenance at the Client’s request; the Client receives an account with administrative privileges (sudo) and is responsible for its use.
8.4.14. History of this section. Version 1.0 (October 24, 2026): creation of the Bare Metal and Dedicated GPU section and revision of clause 8.3.
